OHm Wellness Concierge Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, booking pages, communications, and concierge services offered by OHm Wellness Concierge (“OHm,” “we,” “us,” or “our”). By using our website, requesting services, or booking an experience through OHm, you agree to be bound by these Terms.

1. Services

OHm Wellness Concierge provides wellness-focused concierge and coordination services for guests, hosts, and clients, including but not limited to arranging or facilitating services such as yoga, massage, fitness, private chefs, wellness experiences, curated itineraries, and related offerings.

OHm does not provide services directly, but OHm acts as a curator, coordinator, and booking facilitator for third-party providers.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use our services. By booking with OHm, you represent that all information you provide is accurate and complete.

3. Booking Requests; No Guarantee of Availability

All services are subject to availability. Submission of a request does not guarantee acceptance, confirmation, timing, pricing, or provider availability.

Quoted pricing may change if:

  • your requested details change, 

  • the number of guests changes, 

  • location logistics change, 

  • provider availability changes, 

  • taxes, fees, gratuities, travel charges, or vendor charges apply. 

A booking is not confirmed until OHm issues written confirmation and any required payment or deposit is received.

4. Third-Party Providers

Services offered through OHm are performed by independent third-party providers, including but not limited to wellness practitioners, instructors, chefs, therapists, drivers, and other service professionals.

By using OHm, you acknowledge and agree that:

  • third-party providers are independent contractors and not employees of OHm; 

  • OHm does not own, manage, supervise, or control every aspect of third-party provider services; 

  • OHm does not guarantee the quality, safety, legality, suitability, availability, or results of any third-party service; 

  • OHm is not responsible for the acts, omissions, negligence, misconduct, cancellations, delays, injuries, losses, damages, or failures of any third-party provider. 

OHm may assist in resolving issues in good faith, but OHm is not liable for third-party performance.

5. Payment Terms

You agree to pay all charges associated with your booking, including service fees, coordination fees, vendor fees, travel fees, gratuities where applicable, taxes, and any additional charges disclosed before confirmation.

Unless otherwise stated:

  • payment may be due in full at booking; 

  • some experiences may require a non-refundable deposit; 

  • card-on-file authorization may be required; 

  • OHm reserves the right to cancel or decline any booking for nonpayment. 

If OHm advances funds or guarantees payment to a provider on your behalf, you remain responsible for the full amount due.

6. Cancellation, Rescheduling, and Refunds

Because OHm coordinates time-sensitive services with third-party providers, cancellations and refunds are limited.

Unless a different policy is stated in writing for a particular booking:

  • cancellations made 48 hours or more before the scheduled service are eligible for a refund of amounts paid, less any non-refundable processing fees, vendor deposits, or planning fees already incurred; 

  • cancellations made less than 48 hours before the scheduled service may be subject to partial or full forfeiture; 

  • same-day cancellations and no-shows are generally non-refundable; 

  • rescheduling is subject to provider availability and may involve additional charges. 

Custom itinerary design, planning retainers, rush coordination, and special-order services are non-refundable once work has begun.

If a provider cancels, OHm may, at its discretion, offer a replacement provider, reschedule, issue a credit, or provide a refund to the extent OHm recovers funds or determines one is appropriate.

7. Guest Responsibilities

You agree to:

  • provide accurate booking details and any material health, safety, accessibility, location, or scheduling information; 

  • ensure the service location is safe, legal, clean, and suitable for the requested service; 

  • comply with all property rules, community rules, and applicable laws; 

  • behave respectfully toward providers, hosts, staff, and other guests; 

  • ensure that minors are supervised at all times; 

  • refrain from harassment, discrimination, intoxicated misconduct, illegal activity, unsafe conduct, or abusive behavior. 

OHm or any provider may refuse, stop, or cancel service if a guest appears intoxicated, unsafe, abusive, medically unfit for the service, or otherwise creates a risk.

8. Wellness Disclaimer; Not Medical Advice

OHm’s services are intended to support comfort, wellness, leisure, and lifestyle experience. Unless expressly stated otherwise, OHm and its providers do not provide medical care, mental health treatment, diagnosis, or emergency services.

Nothing on OHm’s website, communications, or booking materials constitutes medical advice. You should consult a qualified physician or other licensed healthcare professional regarding any medical condition, injury, pregnancy, recent surgery, allergies, or limitations before participating in any wellness service.

You are solely responsible for determining whether a service is appropriate for you.

9. Assumption of Risk

You understand that participation in wellness, movement, bodywork, culinary, outdoor, travel-related, and in-home services may involve risks, including but not limited to:

  • physical injury, 

  • allergic reaction, 

  • dizziness, 

  • emotional discomfort, 

  • falls, 

  • property damage, 

  • transportation-related risks, 

  • exposure to environmental conditions. 

By participating, you voluntarily assume all risks associated with the services to the fullest extent permitted by law.

10. Release and Limitation of Liability

To the fullest extent permitted by law, OHm shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of enjoyment, lost profits, lost opportunities, travel disruption, personal injury, illness, allergic reaction, property damage, theft, delay, cancellation, or provider nonperformance arising out of or relating to the use of our website or services.

Without limiting the foregoing, OHm is not liable for:

  • acts or omissions of hosts, guests, vendors, or other third parties; 

  • inaccurate or incomplete information provided by users or providers; 

  • service interruptions, weather events, travel delays, utility failures, or force majeure events; 

  • the outcome, effectiveness, or satisfaction level of any wellness service. 

If OHm is found liable for any claim, OHm’s total aggregate liability shall not exceed the total amount actually paid to OHm for the specific booking giving rise to the claim.

11. Property Damage and Unsafe Conditions

You are responsible for any loss or damage caused by you, your group, invitees, children, or pets in connection with a booked service.

If a service cannot be performed because the location is unsafe, inaccessible, unsanitary, misrepresented, or otherwise unsuitable, the booking may be cancelled without refund.

12. Communications; SMS and Email

By providing your phone number and email address, you consent to receive service-related communications from OHm, including booking confirmations, reminders, updates, and support messages. Message and data rates may apply. You may opt out of promotional communications, but transactional and service-related communications may still be sent as needed.

13. Privacy

Your use of OHm’s services is also subject to our Privacy Policy. You authorize OHm to share relevant booking information with third-party providers to the extent reasonably necessary to coordinate your requested services.

14. Intellectual Property

All OHm branding, text, graphics, logos, images, website content, and service descriptions are owned by OHm or used with permission and may not be copied, reproduced, distributed, or used without prior written consent.

15. Force Majeure

OHm shall not be responsible for delay, disruption, or failure to perform caused by events beyond OHm’s reasonable control, including but not limited to weather, illness, transportation disruption, natural disaster, government action, labor interruption, venue closure, power outage, internet failure, or public health emergency.

16. Termination

OHm may refuse service, suspend access, or cancel bookings at any time if you violate these Terms, provide false information, behave abusively, endanger others, attempt to circumvent OHm’s booking process, or otherwise create legal, operational, or reputational risk.

17. Governing Law

These Terms shall be governed by the laws of the State of Connecticut, without regard to conflict of law principles.

18. Dispute Resolution

Any dispute arising out of or relating to these Terms or OHm’s services shall first be addressed through good-faith informal discussion. If unresolved, the dispute shall be brought exclusively in the state or federal courts located in [Insert County/State], unless OHm elects another lawful dispute-resolution procedure in writing.

19. Changes to These Terms

OHm may update these Terms from time to time. Updated Terms become effective when posted or otherwise communicated. Continued use of OHm’s website or services after the effective date of revised Terms constitutes acceptance.
